Soweit wir als Rechtmäßigkeitsgrundlage für die Verarbeitung personenbezogener Daten unser berechtigtes Interesse oder ein berechtigtes Interesse eines Dritten (Art. 6 Abs. 1 lit. f) DSGVO) anführen, steht Ihnen ein Widerspruchsrecht gemäß Art. 21 DSGVO zu:

Um die folgende Datenschutzerklärung übersichtlich zu halten, verweisen wir an verschiedenen Stellen durch Links auf Informationen und Datenschutzhinweise, die sich auf externen Webseiten befinden. Wir sind sehr bemüht die Verlinkungen, die wir in dieser Datenschutzerklärung aufführen auch aktuell zu halten. Dennoch ist aufgrund der stetigen Aktualisierung der App nicht ausgeschlossen, dass Verlinkungen nicht korrekt funktionieren. 3) Zugang zur App im App Store
Beim Herunterladen unserer App werden erforderlichen Informationen an den jeweiligen App Store (z.B. Google Play, App Store) übertragen. Dabei werden insbesondere folgende Informationen übertragen:
- Nutzername E-Mail-Adresse
- E-mail address
- Zeitpunkt des Downloads
- Gerätekennziffer
Auf diese Datenverarbeitung haben wir keinen Einfluss und sind hierfür nicht verantwortlich.

Rechtsgrundlage für die Speicherung ist unser berechtigtes Interesse gem. Art 6 Abs. 1 lit f) DSGVO. Wir haben ein berechtigtes Interesse daran, nachzuhalten, wie viele Nutzer sich die APP heruntergeladen haben.
Des Weiteren speichern wir die Daten, um ggf. noch einmal mit Ihnen zu Zwecken der Auswertung einer weiteren BETA-Version in Kontakt zu treten. In diesem Fall holen wir Ihr Einverständnis ein (s.u. Ziffer 7) ein.
Eine andere Verarbeitung der Daten findet nicht statt. Der oben beschriebenen Verarbeitung Ihrer personenbezogenen Daten durch uns, können Sie hier widersprechen.

4) Telemetriedaten
Wenn Sie unsere APP nutzen, erfassen wir automatisiert Daten und Informationen vom System Ihres Geräts und speichern diese. Da es sich bei der APP noch um eine Beta-Version handelt, sind wir in besonderem Maße auf Daten zum Zweck der Fehlerbeseitigung und Weiterentwicklung der APP angewiesen.
Hiervon sind folgende Angaben erfasst:

Zweck dieser Verarbeitung ist die Abrufbarkeit der APP von Ihrem Gerät und das Ermöglichen einer korrekten Darstellung unserer APP auf Ihrem Gerät. Weiterhin dienen uns die Daten zur Weiterentwicklung und Verbesserung der APP, statistischen Zwecken und zur Sicherstellung der Sicherheit unserer Systeme. Eine Auswertung dieser Daten zum Zwecke des Marketings findet nicht statt. Es werden auch keine Benutzereingaben gespeichert.
Rechtsgrundlage für die Verarbeitung ist Art. 6 Abs. 1 lit. f) DSGVO. Wir haben ein berechtigtes Interesse daran, Ihnen eine für Ihre Geräte optimierte APP zu präsentieren und Ihnen eine Kommunikation zwischen unseren Anwendungen und Ihrem Endgerät zu ermöglichen sowie unsere APP weiterzuentwickeln und zu verbessern.

5) Information on Google services
We use various services of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA („Google“) in our app.
You can find more information on the individual concrete services from Google that we use in this app in the further privacy policy.
Through the integration of Google services, Google may collect and process information (including personal data). It cannot be ruled out that Google also transmits the information to a server in a third country.
As can be seen from Google’s Privacy Shield certification (available at https://www.privacyshield.gov/list under the search term „Google“), Google has committed to comply with the EU-US Privacy Shield Framework and the Swiss-US Privacy Shield Framework on the collection, use and retention of personal data from the member states of the EU and Switzerland, respectively. We ourselves cannot influence which data Google actually collects and processes. However, Google states that the following information (including personal data) may be processed:

6) Functions of the APP
Mobile information app that gives users maximum real-time insight into their sales, account activity, time-sensitive actions and long-term statistics.

8) Newsletter
We offer a newsletter.
If you would like to subscribe to our newsletter, we require the following personal data from you:
- E-mail address
Registration for the newsletter takes place via the Beta User registration form. The newsletter is sent exclusively with your express consent. After you have entered your surname, first name and e-mail address, you will receive a confirmation e-mail at the specified e-mail address. With an explicit confirmation by clicking on a link in the e-mail, the newsletter is sent (so-called double opt-in).
The purpose of processing and storing the e-mail address is to send you the newsletter.
The legal basis for the processing of personal data described here within the scope of the newsletter is your express consent pursuant to Art. 6 (1) a) GDPR.
Right of withdrawal
You have the right to revoke your consent at any time without affecting the lawfulness of the processing carried out on the basis of the consent until revocation. You can send or communicate your revocation of consent to us at any time (e.g. by e-mail to [email protected]).

9) Hubspot Pixel
We use services from Hubspot, HubSpot, Inc („HubSpot“), 25 First Street, 2nd Floor Cambridge, MA 02141, USA in our app.
Hubspot uses „cookies“, which are text files placed on your device, to help the website analyse how users use the websites/apps they visit. Hubspot may also use so-called web beacons or pixels (invisible graphics). These web beacons or pixels can be used to analyse information such as visitor traffic to websites/apps. The information generated by cookies and web beacons / pixels about the use of our app (including the user’s IP address) is transmitted to a Hubspot server and stored there. This information may be passed on by Hubspot to their contractual partners.
The data is transferred to the USA. The legal basis depends on the function in which personal data is transferred. In this context, we as the data controller may ourselves transfer data to Hubspot in the USA for further use; the transfer may be based on the following so-called standard contractual clauses:
- Commission Decision of 15.06.2001 on standard contractual clauses for the transfer of personal data to third countries under Directive 95/46/EC (2001/497/EC)
- Commission Decision of 27 December 2004 amending Decision 2001/497/EC as regards the introduction of alternative standard contractual clauses for the transfer of personal data to third countries (2004/915/EC).
If Hubspot is acting as our processor in the USA, the transfer to the USA will be based on the
- Commission Decision of 5 February 2010 on standard contractual clauses for the transfer of personal data to processors established in third countries under Directive 95/46/EC of the European Parliament and of the Council (2010/87/EU).
As part of the user analysis, Hubspot processes the following (personal) data:
- Geographical position
- Browser type
- Navigation information
- Reference URL
- Performance data
- Frequency of application use
- Mobile apps data
- Login information for the Hubspot subscription service
- Files displayed on site
- Domain names
- Aggregated use
- Duration of the visit
- Access times
- Clickstream data
Furthermore, we have concluded an order processing agreement with Hubspot Inc. for the use of Hubspot (Art. 28 GDPR). Hubspot processes the data on our behalf in order to evaluate your use of the app, to compile reports on app activities for us and to provide us with other services related to app use and internet use. Hubspot may transfer this information to third parties where required to do so by law, or where such third parties process the information on Hubspot’s behalf.
By integrating Hubspot, we pursue the purpose of analysing user behaviour on our app and being able to react to this. This allows us to continuously improve our offer.
The purpose of processing the data collected in the course of the declaration of consent is to record your consent.
The legal basis for the processing of personal data described here in the context of the measurement procedure is your express consent pursuant to Art. 6 (1) a) GDPR.
The legal basis for processing those data that are processed in the context of obtaining consent is our legitimate interest pursuant to Art. 6 (1) lit. f) DSGVO. We have a legitimate interest in being able to prove that you have given your consent to the measurement procedure (Art. 7 (1) GDPR).

11) Use of YouTube
We use videos from YouTube on our website. YouTube is a service provided by YouTube LLC („YouTube“), 901 Cherry Ave, San Bruno, CA 94066, USA. YouTube LLC is a subsidiary of Google Ireland Limited („Google“), Gordon House, Barrow Street, Dublin 4, Ireland.
YouTube is integrated by embedding the service on our website using a so-called „iFrame“. When loading this iFrame, YouTube or Google may collect and process information (including personal data). It cannot be ruled out that YouTube or Google also transmits the information to a server in a third country.
We use YouTube in the so-called „extended data protection mode“. According to the information provided by Google, this allows a video to be played without the user behaviour being recorded by cookies. We ourselves do not collect any data when you watch a YouTube video on our website.
By integrating YouTube, we pursue the purpose of being able to present various videos to you on our website so that you can watch them directly on our website.
